This agreement (the 'Agreement') is made and entered into as of [Date] by and between [Contributor's Full Name], an individual (the 'Contributor'), and the Ynternet.org Foundation, a Swiss foundation (the 'Foundation').
The Contributor agrees to make a financial donation of the chosen and paid amount (the "Financial Contribution") to the Ynternet.org Foundation to support the conceptualization and development of WikiDeal's Prototype 1 (the "Project"). This Donation is part of a limited fundraising call capped at a total of 1,000,000 CHF.
The Foundation shall use the Financial Contribution solely for the purpose of developing the Project, in accordance with the deliverables set forth in Appendix A.
The Foundation commits to using its best efforts to realize the Project and deliver the expected outcomes and deliverables (Appendix A).
The Contributor acknowledges that there is no absolute guarantee of success. The Project involves inherent technical, commercial and operational risks. The Financial Contribution is a donation made at the Contributor's own risk, without right of termination or legal recourse.
The Contributor is granted optional subscription Rewards based on their Donation. These Rewards are governed by the framework published on the WikiDeal platform, which may evolve over time. While the Foundation has a clear intention to pay out these Rewards based on future platform subscriptions, they are community redistribution algorithms, not contractual promises of return. There is no absolute guarantee of financial return or cash-out.
The Foundation shall not be liable for any losses or damages arising directly or indirectly from the Contributor’s Financial Contribution or the development of the Project.
This Agreement constitutes the entire agreement between the parties. The Contributor expressly waives their right to ordinary jurisdiction in favor of the simplified arbitration process, as described and under construction on the WikiDeal platform (Arbitration).
The deliverables referenced above are living documents, maintained publicly on the WikiDeal site. The versions applicable to this Agreement are those published at the date of signature. At each signature, a dated snapshot of these pages is produced and stored in the versions folder. The link to that snapshot is handed to the Contributor together with their certificate.
