Article 1 β Parties and Purpose
This agreement is entered into between the Family (hereafter "Recipient") and the Babysitter (hereafter "Provider"), both registered users of the WikiDeal Babysitting Portal holding valid Credits. The purpose of this agreement is to define the terms under which the Provider will care for the Recipient's child(ren) during the agreed periods. Both parties acknowledge that WikiDeal acts as a neutral platform Infrastructure provider, not as an employer or staffing agency.
The Recipient acknowledges that the Provider is an independent contractor. The Provider acknowledges the Recipient's parental authority and agrees to act at all times in the best interests of the child(ren) in their care. This agreement does not constitute an employment relationship under Swiss law or the law of the parties' jurisdiction.
Article 2 β Scope of Services and Schedule
The Provider agrees to care for the child(ren) named in the platform profile during sessions scheduled through the WikiDeal platform. Sessions begin and end at times confirmed by both parties via the platform's scheduling interface. A confirmed session constitutes a binding commitment by both parties; cancellations must respect the notice periods defined in Article 4.
The scope of care includes: basic supervision and engagement; meal preparation if pre-arranged; assistance with bedtime routines if applicable; and immediate notification of the Recipient in the event of any concern, accident, or unexpected development. The Provider agrees to follow any specific care instructions provided by the Recipient through the platform's instruction field, provided those instructions are lawful and reasonable.
Article 3 β Compensation and WikiDeal Commission
The hourly rate is agreed between the parties before the session is confirmed, displayed transparently on the platform. The WikiDeal platform Commission is 1.5% of the total session value, deducted automatically and itemised in both parties' Transaction receipts. This Commission covers payment processing, platform maintenance, arbitration fund, and Open Call contributions β nothing more. No hidden fees apply.
Payment is processed through the platform at session completion. If a session runs over the agreed time, additional time is charged at the same hourly rate, rounded to the nearest 15 minutes, and requires explicit acceptance by the Provider before processing. The Provider's right to payment is unconditional once the service is delivered in accordance with this agreement.
Article 4 β Cancellation and Compensation for Delays
Cancellations by the Recipient with less than 24 hours' notice incur a compensation equal to 50% of the agreed session value, payable to the Provider. Cancellations with less than 2 hours' notice incur a compensation equal to 100% of the agreed session value. The Provider may cancel without penalty with at least 48 hours' notice; cancellations with less notice require written justification and may affect the Provider's platform reputation score.
If the Recipient is more than 30 minutes late returning at the end of a session, additional time is charged at 150% of the standard hourly rate. If the Provider must leave urgently and cannot extend (confirmed via platform), the Recipient acknowledges responsibility for ensuring a substitute carer is arranged immediately. Practical cases: absence of water or electricity at the care location, lack of essential supplies (bedding, food) for an infant, or any unsafe condition must be reported immediately through the platform's emergency notification system.
Article 5 β Dispute Resolution and Arbitration
Any dispute arising from this agreement shall first be addressed through the WikiDeal platform's in-app messaging system, which automatically timestamps all communications. If resolution is not achieved within 72 hours, either party may invoke WikiDeal Arbitration. The arbitration panel consists of three trained community arbitrators selected by the User Group. Their decision is binding on platform-related matters (payment disputes, reputation scores) and may be referred to formal legal proceedings for matters outside the platform's authority.
The Recipient and Provider agree to participate in good faith in any arbitration process. False or misleading statements during arbitration proceedings are grounds for suspension from the WikiDeal platform. WikiDeal arbitration decisions are published (anonymised) as case studies, contributing to the platform's open legal knowledge base under CC BY-SA.
