πŸ“‹ Contract Model 4 β€” Musician / Artist Performance Contract
Parties: Event Organiser (Recipient) Β· Performer (Provider)
Platform: WikiDeal Arts Portal
Duration: Single event or series
Commission: 1.8% (at cost)
Arbitration: WikiDeal Arbitration Panel
License: CC BY-SA 4.0

Article 1 β€” Parties, Performance, and Rider

This agreement is between the Event Organiser (Recipient) and the Musician or Artist (Provider), both registered on the WikiDeal Arts Portal. The Provider agrees to deliver the performance described in the booking specification (genre, duration, repertoire notes, technical requirements) at the agreed location and time. A technical rider specifying sound, lighting, and backstage requirements must be submitted via the platform's rider tool at least 7 days before the event; the Recipient commits to meeting reasonable rider requirements or notifying the Provider of constraints so alternatives can be agreed.

Article 2 β€” Performance Obligations and Quality

The Provider shall arrive at the venue no less than 60 minutes before the agreed performance start time for sound check and setup, unless otherwise agreed. The performance shall last for the agreed duration (Β±10 minutes for artistic reasons, with Recipient notification). The Provider shall perform in a professional manner appropriate to the event type and audience. Live performance naturally involves variability; the Recipient acknowledges this and agrees that minor deviations from expected repertoire or style do not constitute breach of contract unless they materially alter the nature of the performance agreed.

Article 3 β€” Compensation, Deposits, and Force Majeure

The agreed fee is specified in the platform booking. A deposit of 30% is processed by the platform upon booking confirmation; the remaining 70% is processed upon performance completion. If the event is cancelled by the Recipient with less than 14 days' notice, the deposit is retained by the Provider. If cancelled with less than 48 hours' notice, the full fee is payable. Force majeure events (natural disasters, government orders, venue closure beyond the parties' control) are handled under the WikiDeal Force Majeure Protocol: fees are held in escrow and rescheduled within 90 days, with no penalty to either party if rescheduling is not possible.

Article 4 β€” Intellectual Property and Recording

The Recipient may not record, broadcast, or livestream the performance without the Provider's prior written consent, documented via the platform's recording authorisation tool. If recording is authorised, the Provider retains copyright in their original compositions and arrangements. Covers of third-party works require separate licensing (the Recipient's responsibility for public events). The Provider warrants that they hold all necessary rights to perform the agreed repertoire. Any authorised recording made by the Recipient may not be used for commercial purposes without a separate written agreement.

Article 5 β€” Dispute Resolution and Reputation

In the event of dispute (non-payment, performance quality, technical failure attributable to either party), the parties agree to raise the dispute within 7 days of the event via the WikiDeal platform. Evidence (booking records, communications, technical rider documentation, and any agreed recordings) is automatically available to the arbitration panel. The Platform's reputation system reflects arbitrated outcomes; providers and recipients with a history of substantiated complaints may be subject to User Group review or conditional platform access.
